Optional Media Release; Photographs, Video, Audio, Testimonials and Likeness

From time to time, we and our participating locations, franchisees, affiliates, related entities, advertising agencies, contractors, service providers, licensees, successors and assigns may request permission to photograph, film, record, interview, or otherwise capture (the "Media") a student, parent/guardian, instructor, employee, customer, participant or other individual in connection with our programs, events, training, marketing, promotions, public relations, educational materials, recruitment, social media, website content, advertising or other communications.

This Media release is optional. Your agreement to this section is not required in order to purchase, register for, participate in, or receive driver training services, except where collection, use or disclosure of information is required for service delivery, safety, security, incident investigation, insurance, regulatory, legal, instructional, quality assurance or other operational purposes described in our Privacy Policy or otherwise permitted or required by law.

Where you expressly agree to a Media release online, by signing a paper form, or by otherwise providing express written or electronic consent, you authorize Young Drivers of Canada and the parties listed above to collect, record, use, reproduce, edit, crop, adapt, publish, display, distribute, transmit and otherwise use your name, image, photograph, video image, voice, likeness, appearance, statements, testimonials, biographical information, and any related recording or content in any format or media, whether now known or later developed, including websites, social media platforms, digital advertising, print advertising, brochures, posters, training materials, presentations, emails, public relations materials, news media, internal communications and other promotional or educational materials.

You understand and agree that:

  1. We may edit, crop, adapt, combine or modify the Media, provided that it is not used in a manner that is intentionally misleading, defamatory or unlawful.
  2. We may use the Media with or without your name, and may use your first name, initials, city, province, testimonial, statement or other approved identifying information where you have consented to that use.
  3. You will not receive compensation, royalties or further payment for the authorized use of the Media unless a separate written agreement states otherwise.
  4. You waive any right to inspect or approve the finished materials or the manner in which the Media is used.
  5. To the extent permitted by law, you release Young Drivers of Canada and the parties listed above from claims arising from the authorized use of the Media, including claims based on privacy, publicity, personality rights, copyright, moral rights, defamation, misappropriation, distortion, alteration, optical illusion, editing or use in composite form.
  6. You represent that you have the legal authority to provide this consent. If the person appearing in the Media is under the age of majority or is otherwise unable to provide meaningful legal consent, a parent or legal guardian must provide consent on their behalf, and we may also request the student’s assent where appropriate.

You may withdraw your consent for future use of the Media by contacting us at info@yd.com or any other contact method stated in our Privacy Policy. Withdrawal will not affect uses that occurred before Young Drivers of Canada received and processed the withdrawal request, materials already printed or distributed, content already published or shared by third parties, or records that we are legally or reasonably required to retain.
